Patents – PCT Enters Into Force in Chile
and Peru
Chile and Peru became the 140th and 141st contracting
states of the Patent Cooperation Treaty (PCT) when they
deposited their instruments of accession at WIPO on
02.Mar.2009 and 06.Mar.2009, respectively. The Treaty
will enter into force for Chile on 02.Jun.2009, and
for Peru on 06.Jun.2009.
The accession by Chile
and Peru means that in any international application
filed on or after the date on which the Treaty enters
in force in these two countries, they will be automatically
designated as countries where the extension of the protection
may, in the right moment, be requested. Also, nationals
and residents of Chile and Peru will themselves be able
to file PCT applications enjoying, besides all the other
benefits of filing through PCT, a 90% reduction in respect
to certain PCT fees, which is extended to some states
