– Portuguese PTO launches PPH with Spain
Source: INPI/PT [adapted]
The Patent Prosecution Highway (PPH)
project between the Portuguese National Institute of
Industrial Property (INPI/PT) and the Spanish Patents
and Trademarks Office (OEPM) is already available in
accordance with the Memorandum of Understanding signed
in March this year.
The PPH is a bilateral and bidirectional
mechanism that allows the sharing of research tasks
of patent applications between the INPI/PT and OEPM.
Through the PPH, the title-holder of a Portuguese patent
application seeking to protect the same invention in
Spain will have access to an “accelerated”
procedure of search and examination of his application
at the OEPM due to the recognition of the search activities
already undertaken by the INPI/PT. Thus, companies,
universities and national inventors will have access
to a “highway” for the internationalization
of their patent applications in the Spanish territory.
Basically, the main goal is to provide a more speedy
the granting of a patent application, which is filed
in the two partner Institutes.
