The Brazilian Superior Court of Justice (STJ) unanimously decided that considers guilty the company “Confecções Lego Ltda”, to do not use identical or confusingly similar expression to “Lego” under any circumstances, with daily charges. The companies Lego Produktion AG and Lego do Brasil Ltda suited an action proving their ownership of Lego trademark register since 1985 and the integration of the expression on their commercial names. Although the activities of the Brazilian company is different of the company Lego Production AG´s. and Lego do Brasil Ltd.´s, the Court understood that it is a case of a high renown trademark, protecting costumers rights.
