- Public bids and incentives for innovation
Amendments to the Law no. 8666/1993

Apart from other
changes to the legislation related to innovation, the
Provisional Measure (MP) no. 495, of 19.Jul.2010, introduced
amendments to Law no. 8666/1993, which establishes the
conditions and procedures for public biddings in Brazil.
One of the main changes provided by the
MP is the definition of a “preferential margin”
in order to benefit bid offers that: (i) generate jobs
and income; (ii) produce effects in tax collection;
and (iii) involve the development and technological
innovation realized in Brazil.
On item 12, the MP Statement of Grounds
expressly justified the institution of a preferential
margin associated with technological innovation in Brazil
due to the fact that “relatively few patents are
being registered in comparison with developed countries”.
The MP must yet be converted by the Congress into law
in order for the changes to become definitive.
