Authorities
from the industrial property offices of Chile, Uruguay,
Argentina and Peru met at the Brazilian INPI (National
Institute of Industrial Property) in order to give continuity
to the creation of a common data system that will help
and guide entrepreneurs and researchers on how to better
protect their creations in those countries.
During this first
phase, which shall be concluded in 2011, the system
is based on the continuous construction of a platform
for the South American Industrial Property Web Portal.
The idea is to establish operating agreements that will
permit a single application to be filed and examined
regionally, and then move on to the national phases
of examination. Such agreements shall work as search
and examination procedures without compromising the
territorial criterion of granting.
The second phase,
which begins in 2012, is forecast to be concluded in
2014 and provides for the distribution of patent examinations
by countries. Each INPI, coordinated by a given country,
will specialize in a specific technological field for
the examinations, according to its capacity to take
on applications. The third phase, to be concluded in
2015, will be the definite creation of a South American
Industrial Property Office.
As per the
document produced by the representatives, the joint
efforts of the offices could well be the safest path
for an effective harmonization of the governments in
the industrial property field.
