>[10.Dec.08] General - INPI/BR Sets Forth Norms for Agent Certification
Source: INPI/BR [Adapted]

In three resolutions published on RPI 1979 on 09.Dec.2008, INPI created norms for the certification of Industrial Property agents and promulgated the Rules of Professional Conduct and Responsability of said activity. According to the rules, the agents will be certified through public examination publicly called by the Institute, and could even lose their status in case of irregular behavior.

One of the resolutions determines the documentation needed for the agents certification, establishes the procedures for the payment of annual fees by the professionals and informs which are the functions of the Industrial Property Agents Registry Commission (COCAPI).

It should be remembered that the agent is an autonomous professional, or a legal entity that is authorized by the Institute to represent the parties interested in the protection of Industrial Property rights.

Finally, the Rules of Professional Conduct creates norms for the client-agent relationship and, in case of irregularities, provides notices of warning, temporary suspension and even definite cancellation of the registration of certification. The accusations will be analyzed by the Industrial Property Agent Professional Conduct and Responsibility and Ethics Commission.
